Family & Partner Visas

Australia offers a range of family visas

Family visas provide pathways for reuniting families and loved ones within the country. These visas are designed to foster strong family bonds, allowing eligible individuals to live, work, and study in Australia with their Australian citizen, permanent resident, or eligible New Zealand citizen family members. 

Partner Visas (Subclass 820/801 and Subclass 309/100)

The Partner Visas cater to individuals in committed relationships with Australian citizens, permanent residents, or eligible New Zealand citizens. There are two streams: the onshore Subclass 820/801 visa for applicants already in Australia and the offshore Subclass 309/100 visa for applicants applying from outside Australia. These visas offer temporary and then permanent residency options, allowing couples to build their lives together in Australia.

 

Basic Requirements:

  • Be in a genuine and committed de facto relationship or be legally married.

  • Be sponsored by your partner.

  • Evidence of shared life with your partner.

  • Must have been in a de facto relationship or married for at least 12 months before applying unless compelling circumstances apply.  

  • For the permanent residency stage, evidence of functional English is required. 

Child Visas (Subclass 101, 102, 445, and 802)

Child Visas are available for dependent children of Australian citizens, permanent residents, or eligible New Zealand citizens. The appropriate visa depends on the child's location and the circumstances of the sponsoring parent. These visas allow children to join their parents in Australia and enjoy access to quality education, healthcare, and a nurturing environment.

 

Basic Requirements:

  • The child must be under 18 years of age, or over 18 but under 25 years of age and a full-time student, or over 18 and unable to work due to a disability.

Parent Visas (Subclass 103, 804, 143, 173, 804, and 884)

The Parent Visas cater to parents who wish to live in Australia with their Australian citizen, permanent resident, or eligible New Zealand citizen children. There are various visa options, including Contributory and Non-Contributory visas, with varying processing times and requirements. These visas offer parents the opportunity to be close to their children and share in their family's milestones.

 

Basic Requirements:

  • The parent must be in or outside Australia at the time of application and when the visa is granted depending on the type of visa. 

  • The parent must be the biological, adoptive, or stepparent of an Australian citizen, permanent resident, or eligible New Zealand citizen child who is settled in Australia.

  • The parent must meet the balance of family test, which means at least half of their children must be Australian citizens, permanent residents, or eligible New Zealand citizens, or more children must be living in Australia than in any other single country.

  • For certain type of parent visas, the parent must be of eligible age (usually pension age or older).

Other Family Visas
(Subclass 114, 115, 116, 837, 838, 852, and 864)

This category includes visas for fiancés, remaining relatives, aged dependent relatives, and carers of Australian citizens, permanent residents, or eligible New Zealand citizens. These visas provide avenues for extended family members to reunite with their loved ones in Australia and offer support during important life stages.
